A great many disputes involving Indigenous parties are resolved through alternative dispute resolution, involving negotiation and mediation. More than ever negotiated resolution of protracted, historical disputes occur on a renewed nation to nation basis. The federal government established the Recognition of Indigenous Rights and Self-Determination (RIRSD) Exploratory Discussion Tables program in 2016 and as a result many issues that otherwise may have been headed for Canadian courts or tribunals are being actively addressed through negotiation.
